Disclosure in Accordance With Law No. 6698 on the Protection of Personal Data

TKYB careS about your security and the protection of your fundamental rights and freedoms and would like to inform you about Law No. 6698 on the Protection of Personal Data.
To provide secure and uninterrupted services in Turkey and abroad, the Bank may need to collect, process and transfer to third parties any personal data submitted by clients to the Bank or obtained by the Bank through various channels.
The Bank takes security measures to protect your privacy in the collection, processing, storage and, if necessary, sharing of your personal data in compliance with the law.
a) Data Controller
In compliance with Law No. 6698 on the Protection of Personal Data (Law No. 6698), TÜRKİYE KALKINMA VE YATIRIM BANKASI A.Ş. as the data collector can collect and process your personal data.
b) Purposes of Processing Data
In compliance with the personal data processing conditions and purposes set forth in Articles 5 and 6 of Law No. 6698, your personal data will be processed to provide you with a better and more secure service and for the fulfillment of your contracts and orders, the evaluations required for the services provided, credit evaluations, banking, insurance, prevention of the laundering of proceeds of crime, capital market, tax, compliance with the national and international legislation of primarily the Social Security Institution and of consumer law, compliance with risk monitoring and information obligations, fulfillment of the information sharing, reporting and information obligations set forth by the Credit Bureau, the Banking Regulation and Supervision Agency, the Central Bank of the Republic of Turkey, the Financial Crimes Investigation Board, the Banks Association of Turkey, the Revenue Administration of the Ministry of Economy of the Republic of Turkey, the Prime Ministry Undersecretariat of the Treasury of the Republic of Turkey and other authorities, fulfillment of the information and document protection obligations stemming from national legislation, prevention of fraud, assurance of security, establishment and implementation of planning and statistics activities required by the Bank, establishment and implementation of the Bank’s trade and business strategies, maintenance of finance, communications, market research and purchasing operations, maintenance of the internal system and implementation management operations of the Bank and management of legal processes and implementation of social responsibility projects.
Within the context of contracts or joint activities with third party natural or legal persons in business relations with the Bank, your personal data may be processed in order to fulfill the legal and commercial obligations, establishment of rights, protection of rights, commercial and legal evaluation processes, legal and commercial risk analysis and implementation of financial affairs stemming from such contracts.
c) To Whom and for What Purposes The Processed Personal Data Can Be Transferred
Your personal data can be transferred to authorities including the Banking Regulation and Supervision Agency, the Capital Markets Board of Turkey, the Central Bank of the Republic of Turkey, the Financial Crimes Investigation Board, the Banks Association of Turkey Risk Center, the Small and Medium Enterprises Development Organization of Turkey, the Revenue Administration of the Ministry of Economy of the Republic of Turkey, the Prime Ministry Undersecretariat of the Treasury of the Republic of Turkey and the Social Security Institution, to public institutions authorized by law such as ministries and judicial authorities, to the Credit Bureau and where legislation allows, to cooperating consultants, institutions, finance institutions, independent audit companies and banks within the limits of related legislation and primarily of the Banking Law and in compliance with Article 8 of Law No. 6698 on the transfer of personal data and with the personal data processing conditions and purposes set forth in Article 9 on the international transfer of personal data to be limited to the achievement of the above-mentioned purposes and to fulfill legislative obligations.
ç) Methods and Legal Reasons of Personal Data Collection
Your personal data is collected through the General Directorate of TÜRKİYE KALKINMA VE YATIRIM BANKASI A.Ş., Istanbul Branch Management, websites, client interviews and written/digital communication through the Bank’s website.
Your personal data collected in this manner are processed and transferred in compliance with Articles 5 and 6 of Law No. 6698 and Articles (b) and (c) of this Disclosure Text.
d) The Rights of the Personal Data Owner in accordance with Article 11 of Law No. 6698 and the amendments to Article 11 of the Law No. 6698 are:

  • To learn whether or not your personal data have been processed,
  • To request information if they have been processed,
  • To learn about the purpose of the procedure and whether the data have been used appropriately for the specified purpose,
  • To be advised of the internal and external third parties that the data have been transferred to,
  • To request the data be corrected, deleted or destroyed, or that such a request be made to the third parties that it was transferred to,
  • To request your personal data be deleted or destroyed once the compelling purposes are no longer valid even if the data has already been processed in compliance with Law No. 6698 and provisions of other relevant laws, and notification thereof to any third parties to whom the data is transferred,
  • To object to any outcome of an automated analysis of processed data that has had a negative result for you,
  • And to ask to be indemnified in the event of any losses incurred due to the illegal processing of such data.

If you submit to the Bank a request concerning your rights, the Bank will reply free of charge as soon as possible and within a maximum of 30 days, depending on the nature of the request. However, if your request incurs any additional costs, the Bank will charge in accordance with the tariff specified by the Personal Data Protection Board.
